Romanian borrowers with loans linked to ROBOR may recover overpaid amounts due to anti-competitive practices. A new legislative proposal aims to recalculate interest rates based on IRCC and allow restitution of proven damages. This applies to loans taken before May 2, 2019, and includes closed loans under certain conditions. The bill, adopted by the Senate, is currently under discussion in the Chamber of Deputies. It follows a Competition Council investigation that fined ten banks a total of 3.73 billion lei for collusion in setting the ROBOR index. Clients can initiate a recalculation request within 45 days of identifying damages, with banks required to respond within specified timeframes. The proposal also includes penalties for banks failing to comply with these obligations.
