The European Commission has initiated an in-depth investigation into whether an arbitration ruling requiring Romania to compensate investors aligns with EU state aid rules. Romania's renewable energy support scheme, established in 2011, faced modifications leading to arbitration claims from ten companies. A tribunal ruled Romania violated the Energy Charter Treaty, ordering compensation of €42.2 million. The Commission's preliminary view suggests the ruling constitutes state aid incompatible with the internal market. The investigation will assess potential violations of EU treaties and the legality of the arbitration within the EU framework.
