Homeowners must continue to pay maintenance fees for their apartments even if they are unoccupied for extended periods. Lawyer Gelu Pușcaș clarifies that ownership includes shared costs for common areas, regardless of occupancy. Expenses for repairs and maintenance of shared facilities, such as elevators and roofs, remain the owner's responsibility. However, costs directly related to the use of the apartment, like utilities, are not applicable when the unit is vacant. The legal basis for these obligations is found in the Civil Code and Law no. 196/2018, which governs homeowners' associations.
