Starting September 15, 2026, new rules for case distribution in Romanian courts will be implemented, as announced by Mediafax. A decision from the Superior Council of Magistracy introduces explicit references to the processing capacity of courts in the internal regulations. The changes affect how cases are prepared and randomly assigned to panels in both first instance and appeal. A clerk with higher education will generally determine the subject of a case under a judge's supervision. The random distribution will now consider the courts' processing capacity, ensuring a more efficient management of case loads. This applies to both first instance and appellate courts, maintaining a separate case file for appeals and recourses.
