The European Commission has initiated infringement proceedings against Romania regarding the taxation of stock market gains. From January 1, 2026, profits from Romanian brokers will be taxed at 3% for shares held over a year and 6% for shorter periods. In contrast, gains from foreign brokers are taxed at 16%, with losses offset against gains within the same year. The Commission argues that Romania's tax regime discourages the use of services from EU and EEA intermediaries, potentially violating EU service provision freedoms. Romania has two months to respond before further legal action may be taken.
