Reacția fermă a CEDO privind salariile justiției din România. „Nu este de competența instanței naționale să se substituie autorităților naționale în alegerea politicilor bugetare”

The European Court of Human Rights ruled that Romanian judges' rights were not violated by staggered salary payments. The court emphasized that national courts should not interfere with budgetary policies. It acknowledged the economic challenges faced by Romania, including the pandemic and the war in Ukraine, which justified the government's decision to delay payments. The court criticized the potential conflict of interest arising from judges litigating their own salary rights. It concluded that judges do not constitute a vulnerable group, as their income exceeds average salaries in Romania. The ruling came shortly after the High Court mandated the government to pay 1 billion euros in salary arrears to judges.
