Predarea telefonului mobil nu înseamnă acord pentru accesarea informațiilor personale
The European Court of Human Rights ruled that voluntarily handing over a mobile phone does not imply consent for accessing personal data. Consent must be informed and free from coercion, and legal protections cannot be bypassed. This decision arose from a case involving Anar Mammadov against Azerbaijan, where the court found that authorities lacked proper legal authorization to examine the phone's data. The court emphasized that the absence of judicial oversight left individuals vulnerable to potential abuses, thus violating the right to privacy. Therefore, surrendering a device does not grant unrestricted access to personal information.
