The court initially sided with the tax authority, citing the high risk of tax evasion associated with such goods. However, the company argued that the shoes were specialized sports equipment, not generic merchandise, and had complied with all other tax obligations. The Tribunal agreed, finding the fine excessive and ultimately annulled it, deeming a warning sufficient.
