After separation, the right to live in a property, ownership, and loan obligations are separate issues. Staying in the house does not grant sole ownership, and leaving does not eliminate bank responsibilities. If the property is jointly owned, spouses can agree on who stays, but if not, a court may decide based on children's interests and living arrangements. For rented properties, similar criteria apply. Separation does not suspend loan payments, and both parties remain liable unless the bank agrees to transfer the loan. Refinancing or selling the property are alternatives, but any remaining debt must be settled. Payments made by one spouse can be reclaimed later.
