Inteligența artificială în sistemul judiciar: între eficiență tehnologică și pericolele automatizării justiției

The global judicial system is increasingly turning to artificial intelligence (AI) to manage overwhelming case loads and improve efficiency. However, this reliance raises significant ethical and systemic concerns, particularly regarding bias, transparency, and the erosion of human judgment. AI systems can perpetuate existing prejudices found in historical data, as seen with the COMPAS algorithm in the U.S., which misclassified risk levels based on race. Additionally, the opaque nature of AI decision-making contradicts the right to a fair trial, as parties cannot challenge unexplainable AI recommendations. The risk of 'automation bias' leads legal professionals to trust AI outputs blindly, sometimes resulting in fabricated legal references. Furthermore, the rise of deepfake technology complicates evidence integrity in trials. While AI can enhance administrative tasks, it should not dictate judicial decisions, emphasizing the need for human oversight in the legal process.
