Dispoziţiile legale ce împiedică unii funcţionari publici să candideze la funcţii de demnitate publică sunt neconstituţionale, a decis CCR

The Romanian Constitutional Court ruled that provisions requiring high-ranking public officials to resign before running for public office are unconstitutional. The court found these rules discriminatory and a hindrance to the right to run for office, violating several constitutional articles. It emphasized that the requirement does not balance public and individual interests and discourages candidacy. The court noted that the right to run for office does not guarantee election, thus it should not replace the right to work.
