The case involved a vehicle with an oil leak, which, while a safety concern, could be repaired at a low cost. The court emphasized that the severity of the defect, repair costs, and the seller's conduct must be considered before canceling the contract. A seller should have the opportunity to fix the issue unless the defect undermines the buyer's trust in the vehicle's reliability. This ruling is significant for Romania, where second-hand car sales are prevalent.
