In a case involving a passenger who bought a flight ticket online, the court clarified that the jurisdiction lies with the airline's operational base, not the passenger's home. This decision aims to balance consumer interests with those of airlines and ensures legal predictability. The court also stated that the Montreal Convention applies to flights within the same member state and that the relevant contract for jurisdiction is the air transport contract, not ancillary services like baggage handling.
