The Court of Justice of the European Union clarified the conditions under which citizens can claim compensation from the state for judicial errors violating EU law. A Romanian farmer's request for agricultural aid was denied due to a discrepancy in eligible land area. After unsuccessful legal actions, he sued the Romanian state for damages, arguing a breach of EU law. The CJUE stated that a court's refusal to refer a question to it does not automatically make the state liable. To claim compensation, three conditions must be met: the violated EU rule must protect a specific right, the violation must be serious, and there must be a direct link between the violation and the claimed damage. The CJUE emphasized that state liability for judicial errors is exceptional and not every judicial mistake warrants compensation.
