Romania's green certificate scheme, established in 2011, faced multiple modifications, leading to arbitration claims from investors in solar projects. A tribunal ruled Romania violated the Energy Charter Treaty, ordering compensation of €42.2 million. The Commission's preliminary view suggests the ruling constitutes state aid incompatible with EU internal market rules. The investigation will assess potential violations of EU treaties and the legality of the arbitration process within the EU framework.
