CCR: Interdicția aplicată înalților funcţionari publici de a candida la funcţii de demnitate publică este neconstituţională

The Romanian Constitutional Court ruled that provisions restricting high-ranking public officials from running for public office only after leaving their positions are unconstitutional. The court unanimously found that these rules discriminate against certain categories of officials and discourage the right to run for office. The decision emphasized that the requirement to terminate service relationships is not proportionate to the intended goal of ensuring public function neutrality. Furthermore, the court noted that the right to be elected does not guarantee actual access to public office, and this perspective cannot replace the right to work.
