CCR: Foștii legionari și copiii acestora pot fi excluși de la drepturile acordate persoanelor persecutate politic

The Romanian Constitutional Court ruled that individuals involved in fascist or legionary activities, along with their children, can be excluded from benefits for politically persecuted persons. This decision confirms the constitutionality of a provision in Decree-Law no. 118/1990, which denies rights to those convicted of crimes against humanity or proven to have engaged in extremist activities. The Court emphasized that such activities must be objectively proven, and decisions can be contested in court. The ruling clarifies that the terms 'fascist' and 'legionar' are sufficiently clear and do not violate legal predictability. The decision is final and binding.
