The Romanian Constitutional Court declared unconstitutional the emergency ordinance that established a special procedure for public sector salary and pension disputes. This decision affects ongoing cases, restoring full jurisdiction to the courts handling these matters. The Court found that the ordinance violated constitutional provisions regarding emergency legislation and the functioning of state institutions. It noted that the introduced mechanism could overwhelm the High Court and disrupt judicial processes. Consequently, cases previously sent to the High Court under this ordinance will be returned to the original courts for resolution. The government had justified the ordinance as a means to unify judicial practice, but existing legal mechanisms already served this purpose.
