Banii firmelor, blocați de noile filtre ANAF? Consultanții fiscali contestă criteriile pentru rambursarea TVA: „Produce efectul opus”

The new risk criteria introduced by ANAF for VAT refunds are hindering businesses and affecting investments and exports, particularly for compliant taxpayers, warns the Chamber of Fiscal Consultants (CCF). These criteria, established by ANAF Order no. 1123, may block VAT refunds even for companies meeting their tax obligations. CCF highlights issues such as a non-public database that companies cannot access to verify shareholders' risk status, and criteria that do not define minimum ownership thresholds. The CCF also points out that companies may be penalized for their suppliers' tax issues, which are not transparent. The president of CCF warns that these measures could lead to greater budgetary losses than the risks they aim to mitigate, causing financial chain reactions. CCF criticizes the lack of justification for the 24 new fiscal risk indicators and suggests that fraud prevention could be achieved through existing digital tools without harming compliant businesses.
