A discrepancy between Romanian tax law and its implementation by ANAF has emerged, affecting many businesses. Despite the enactment of Law no. 177/2026, which cancels certain tax debts, companies continue to receive payment requests from ANAF. The agency has exceeded the legal deadline for issuing application procedures, risking financial burdens for entrepreneurs. Many firms, previously having their VAT codes annulled, face retroactive tax obligations despite not collecting VAT from clients. The law mandates ANAF to cancel debts automatically, yet delays in procedural adoption hinder effective implementation. This situation could lead to businesses losing payment arrangements and facing forced collections. Additionally, the law allows for the refund of previously paid amounts, raising potential budgetary implications for the state.
