Employees who do not take their vacation days for 2026 can recover them until June 30, 2028, according to a ruling by the High Court of Cassation and Justice (ICCJ). The legal deadline for carrying over vacation is 18 months from the start of the following year. However, the ICCJ's decision clarifies that exceeding this period does not automatically result in losing the right to compensation for unused vacation days, depending on whether the employer provided the opportunity to take leave. Employers must ensure that employees can effectively exercise their right to vacation, and compensation in cash for unused leave is only allowed upon termination of employment. The three-year statute of limitations for claiming compensation starts from the end of the employment relationship.
