Homeowners with unpaid maintenance fees are not automatically penalized; penalties depend on the homeowners' association's decision. The attorney Gelu Pușcaș clarified that penalties can only be applied if voted on by the general assembly. The penalties cannot exceed the amount owed and are calculated at a maximum of 0.2% per day after a 30-day grace period. Additionally, penalties cannot be compounded on already accrued penalties. Homeowners have a total of 50 days to pay without penalties, and if the association does not claim the debt within three years, it may be subject to prescription.
