The Constitutional Court ruled that children under 14 who commit crimes can be mandated to undergo psychological counseling, regardless of parental consent. However, penalties for parents and mandatory placement in specialized centers for violent acts were deemed unconstitutional. This decision follows a challenge by President Nicușor Dan regarding amendments to child protection laws. The court upheld the necessity of psychological counseling as beneficial for the child, while rejecting vague definitions and penalties related to parental responsibility. The law will return to Parliament for revisions before it can be enacted. Additionally, a proposal allowing 16-year-olds to seek psychological help independently was rejected, highlighting inconsistencies in access to mental health support.
