An employee was dismissed after refusing to obtain a passport due to fear of flying. The court ruled the dismissal was disproportionate and awarded him €52,000. Giuseppe Capoluongo had worked for Bergami Packaging Solutions for 22 years and had previously informed the company of his aerophobia. Although the company required him to obtain a passport for potential business trips, they had not sent him on flights for over 12 years. The court found that while his delay in obtaining the passport could be a disciplinary issue, it did not warrant termination. The appeal court emphasized the importance of proportionality in the sanction, considering the long-standing understanding between Capoluongo and his employer. The court awarded him compensation equivalent to 20 months' salary, totaling €52,349.20, plus additional amounts for notice and interest.
