The European Commission has initiated an in-depth investigation into whether an arbitration ruling requiring Romania to compensate ten investors due to changes in renewable energy support measures complies with EU state aid rules. Romania's support scheme for renewable energy, approved in 2011, has undergone several modifications, leading to arbitration claims from investors in solar projects. A tribunal ruled that Romania violated the Energy Charter Treaty, ordering compensation of €42.2 million. The Commission's preliminary view suggests that the arbitration ruling constitutes state aid incompatible with the internal market. The investigation will assess potential violations of EU treaties and the legality of the arbitration process within the EU framework.
