ANAF has updated the rules for VAT refunds, introducing new criteria that may classify companies as high-risk for improper refunds. Under the new regulations, certain firms will undergo a tax inspection before receiving their requested refunds. The changes, outlined in Ordinance no. 1.123/2026, expand the list of situations that indicate a risk of improper VAT reimbursement. Factors include the company's financial status, the history of its shareholders, and significant increases in refund requests. Companies must also ensure compliance with tax declaration obligations, as missing forms can trigger risk assessments. The new rules take effect for VAT refund requests from August 2026 onwards, impacting both new and ongoing claims.
