Consent must be notarized and can be denied if the proposed work violates laws or harms neighboring properties without adequate remediation. Unjustified refusals can be challenged in court, allowing permit issuance without neighbor consent. The applicant must prove compliance with these requirements, while public interest projects are exempt from neighbor consent. Neighbors must also allow expert access for assessments.
