Giuseppe Capoluongo, employed since 2002, had previously informed his employer about his aerophobia and had not been required to travel by plane for over a decade. The court found that the long-standing understanding between Capoluongo and the company should have been considered, as he reasonably believed it was still valid. The appeal court emphasized the importance of proportionality in disciplinary actions, leading to the decision to overturn the dismissal and grant compensation.
