The Court of Justice of the European Union ruled that a supplier cannot enforce an abusive price increase clause simply because a customer paid their bills for three years without contesting them. This decision arose from a heating supply contract in Germany, where the customer contested price increases after paying for a period. The court emphasized that an abusive clause cannot continue to have effects against the consumer, and suppliers cannot unilaterally replace such clauses. However, the ruling does not imply that all price increases are abusive or that all paid bills can be automatically recovered; each case must be evaluated individually.
